Kenanté mobile phone application for android , IOS operating and also available on Web
1.1 Use of Kenanté is offered to you conditioned on acceptance of all the terms, conditions and notices contained in these Terms, along with any amendments made by Kenanté at its sole discretion and posted on Kenanté, including by way of imposing an additional charge for access to or use of a Service.
2.1 Kenanté is a platform that facilitates the user to choose to enter into a contest/ contest program and upon answering completely, become eligible for special points, discount coupons and/or offers
3 Eligibility to Use
3.1 The services are not available to minors under the age of Fifteen (15) or to any Users suspended or removed from the Kenanté system by Kenanté or Varenia CIMS for any reason whatsoever. If You do not conform to the above qualification, You shall not be permitted to avail of the Services or use Kenanté. You represent that You are of legal age to form a binding contract and are not a person barred from receiving services under the law as applicable in India.
Notwithstanding the foregoing, if you are below the age of Fifteen (18) years, You may avail the Services provided by Kenanté through Your legal guardian in accordance with the applicable laws provided the user has his own mobile
3.2 Kenanté reserves the right to refuse access to use the Services offered at Kenanté to new Users or to terminate access granteded to existing Users at any time without according any reasons for doing so.
3.3 The user registration is based on the concept of ONE USER ONE MOBILE NUMBER Concept and therefore, User can register only one name with one mobile number.
In case a new user registers on the same mobile phone, the previous user will no longer be deemed as the user on that mobile. In case the user has switched mobile numbers, they need to update their profile via Application/ Website or register again as a new user. Any benefits accrued to user in the old registered to the new account.
4.2 Kenanté requires You to register as a User by creating an Account in order to avail of the Services provided by Kenanté. You will be responsible for maintaining the confidentiality of Account Information, and are fully responsible for all activities that occur under your Account. You agree to (a) immediately notify Kenanté of any unauthorized use of your Account Information or any other breach of security, and (b) ensure that You exit from Your Account at the end of each session. Kenanté cannot and will not be liable for any loss or damage arising from Your failure to comply with this Section 4.2 You may be held liable for losses incurred by Kenanté or any other user of or visitor to Kenanté due to authorized or unauthorized use of your Account as a result of your failure in keeping Your Account Information secured and confidential.
4.3 Kenanté also allows restricted access to the Services for unregistered users.
4.4 You shall ensure that the Account Information provided by you in Kenanté registration form is complete accurate and up to date. Users of another user Account Information for availing the services is expressly prohibited.
4.5 If you provide any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or Kenanté has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Kenanté has the right to suspend or terminate your account and refuse any and all current or future use of Kenanté (or any portion thereof)
4.6 Any personally identifiable data (which includes Phone number, email ID and Address) of the user will not be shared with any third party by Kenanté, but aggregated data (without the personally identifiable information) can be shared with other third party. The data based on contest done by various users would be collected in aggregate form which may be age wise, gender wise, city wise or as the case may be and in aggregate form. Subject to any force majeure event, in no circumstances, Kenanté would release personally identifiable information of the individual users to other companies without prior permission from the said user.
5 Offers / Discount
5.1 Kenanté shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of redemption of points/ discount coupons/ offers by the merchandise/ service providers, on account of any reason whatsoever. This shall remain a matter to be resolved between the parties carrying out the transaction(s).
6 User Obligations
6.3 You agree to adhere to all limitations on dissemination, use and reproduction of any materials (such as the product catalogues) that you access on Kenanté in accordance with section 7.
6.4 You agree not to access (or attempt to access) Kenanté and the materials or Services by any means other than through the interface that is provided by Kenanté. You shall not use any deep-link, robot, spider or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process , to access, acquire, copy or monitor any portion of Kenanté or content (as defined below), or in any way reproduce or circumvent the navigational structure or presentation of Kenanté, materials or any content, to obtain any materials, documents or information through any means not specifically made available through Kenanté.
6.5 You acknowledge and agree that by accessing or using Kenanté or Services, You may be exposed to content from other users that you may be exposed to content from other users that you may consider offensive, indecent or otherwise objectionable. Kenanté disclaimed all liabilities arising in relation to such offensive content on Kenanté. Further, you may report such offensive content in the manner prescribed under section 17 herein.
6.6 If website or mobile phone application for android and iOS operating systems allow s you to post and upload any material on Kenanté, you hereby undertake to ensure that such material is not offensive and in accordance with applicable laws. Further, you undertake not to:
Defame, abuse, harass, threaten or otherwise violate the legal rights;
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic , name, material or information through any bookmark, tag or keyword;
Upload files that contain software or other material protected by applicable intellectual property laws unless you own or control the rights thereto or have received all necessary consents;
Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of Kenanté or another computer; Engage in any activity that interferes with or disrupts access to Kenanté or the Services (or the servers and networks which are connected to Kenanté) ;
Attempt to gain unauthorized access to any portion or feature of Kenanté, any other systems or networks connected to Kenanté to any Kenanté server, or to any of the Services offered on or through Kenanté by hacking password mining or any other illegitimate means;
Probe, scan or test the vulnerability of Kenanté or any network connected to Kenanté, nor breach the security or authentication measures on Kenanté or any network connected to Kenanté or any other customer of Kenanté , including any Kenanté account not owned by you, to its source, or exploit Kenanté or service or information made available or offered by or through Kenanté, in any way whether or not the purpose is to reveal any information, including but not limited to personal identification information, other than your own information, as provided for by Kenanté;
Disrupt or interfere with the security of, or otherwise cause harm to, Kenanté systems resources, accounts, Kenanté or any transaction being conducted on Kenanté, or with any other person use of Kenanté;
Download any file posted by another user of a service that you know, or reasonably should know, cannot be legally distributed in such manner;
Falsify or deleted any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that uploaded;
Violate any code of conduct or other guidelines, which may be applicable for or to any particular service;
Violate any applicable laws or regulations for the time being in force within or outside India;
Reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from Kenanté.
6.8 You agree that Kenanté may, at any time, modify or discontinue all or part of Kenanté, charge, modify or waive fees required to use Kenanté, or offer opportunities to some or all website or mobile phone application for android and iOS operating systems users as the case may be.
7 Use of materials
7.1 Except as expressly indicated to the contrary in any applicable additional terms, Kenanté hereby grants you a non-exclusive, freely revocable (upon notice from Kenanté), non-transferable access to view, download and print product catalogues or any other materials available on Kenanté, subject to the following conditions:
You may not modify or alter product catalogues or any other materials available on Kenanté;
You may not distribute or sell, rent, lease, license or otherwise make the product catalogues or any other materials available on Kenanté.
7.2 The rights granted to you in the product catalogues or any other materials as specified above are not applicable to the design, layout or look and feel of Kenanté. Such elements of Kenanté are protected by intellectual property rights and may not be copied or imitated in whole or in part. The product catalogues or any other materials available on Kenanté may be copied or retransmitted unless expressly permitted by Kenanté.
7.4 Any points/ discount / offer code generated on Kenanté will be strictly for personal use of the user currently registered on that mobile number. The user hereby expressly agrees that any points/ discount/ offer code generated by the user on Kenanté will be sold, resold, bartered or in any way used for any commercial purposes or for profit. The user hereby acknowledges that the discount offer code is not transferrable to any third party for profit.
8 Usage Conduct
8.1 You shall solely be reasonable for maintaining the responsible for maintaining the necessary electronic equipment (e.g. computer, mobile phone etc.) and internet connections that may be required to access, use and transact on Kenanté.
8.2 You are also under an obligation to use this website or mobile phone application for android and iOS operating systems for reasonable and lawful purposes only, and shall not indulged through Kenanté.
8.3 You shall use this website or mobile phone application for android and IOS operating systems, and any voucher/ coupons/ code generated through it , for personal, non-commercial use only and shall not re-sell the same to any other person.
8.4 Kenanté shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any transaction.
9 Intellectual Property Rights
9.1 Kenanté and the processes, and their selection and arrangement, including but not limited to all text, graphics, user interfaces, visual interfaces, sound and music (if any), artwork and computer code (collectively, the content) on Kenanté is owned and controlled by Kenanté and the design, structure, selection, coordination, expression, look and feel and arrangement of such content is protected by copyright, patent and trademark laws, and various other intellectual property rights.
9.2 The trademarks, logos and service marks displayed on Kenanté (Marks) are the property of Kenanté or their vendors or respective third parties. You are not permitted to use the marks without the prior consent of Kenanté, the vendor or the third party that may own the marks.
9.3 Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, Kenanté owns all intellectual property rights to and into the trademark Kenanté, and Kenanté, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, designs, know-how , trade secrets and inventions (patent pending), goodwill, source code, meta tags, databases, text content, graphics, icons, and hyperlinks.
9.4 Except as expressly provided herein, You acknowledge and agree that you shall not copy, republish, post, display, translate, transmit, reproduce or distribute any content through any medium without obtaining the necessary authorization from Kenanté or third party owner of such content.
10 Third Party Content
Kenanté makes available general third party information such as, product catalogues, lists of authorized dealers, reports on news, entertainment, technology and features, advertisements including videos, images and photographs of the products and other data from external sources (third party content). Similar third party content may also be available to you on any email or other communication received by you from Kenanté. The provision of third party content is for general informational purposes only. You acknowledge that the third party content provided to you is obtained from sources believed to be reliable. Kenanté does not provide any guarantee with respect to any the third party content and Kenanté shall not be held liable for any loss suffered by you based on your reliance on or use of such data. The user can also not claim any rights over any third party content provided on Kenanté unless explicitly so stated.
11 Disclaimer Of Warranties and Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
11.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Kenanté WILL HAVE NO LIABILITY RELATED TO USER CONTENT ARISING UNDER INTELLECTUAL PROPERTY RIGHTS, LIBEL, PRIVACY, PUBLICITY, OBSCENITY OR OTHER LAWS. Kenanté ALSO DISCLAIMS ALL LIABILITY WITH RESPECT TO THE MISUSE, LOSS, MODIFICATION OR UNAVAILABILITY OF ANY USER CONTENT.
11.3 Kenanté WILL NOT BE LIABLE FOR ANY LOSS THAT YOU MAY INCUR AS A CONSEQUENCE OF UNAUTHORIZED USE OF YOUR ACCOUNT OR ACCOUNT INFORMATION IN CONNECTION WITH Kenanté OR ANY SERVICES OR MATERIALS, EITHER WITH OR WITHOUT YOUR KNOWLEDGE. Kenanté HAS ENDEAVORED TO ENSURE THAT ALL THE INFORMATION ON Kenanté, BUT Kenanté NEITHER WARRANTS NOR MAKES ANY REPRASENTATIONS REGARDING THE QUALITY, ACCURACY OR COMPLETENESS OF ANY DATA, INFORMATION, PRODUCT OR SERVICE. Kenanté SHALL NOT BE RESPONSIBLE FOR THE DELAY OR INABILITY TO USE Kenanté OR RELATED FUNCTIONALITIES, THE PROVISION OF OR FALIURE TO PROVIDE FUNCTIONALITIES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, FUNCTIONALITIES AND RELATED GRAPHICS OBTAINED THROUGH Kenanté, OR OTHERWISE ARISING OUT OF THE USE OF Kenanté, WHETHER BASED ON CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE. FURTHER, Kenanté SHALL NOT BE HELD RESPONSIBLE FOR NONABILITY OF Kenanté DURING PERIODIC MAINTAINANCE OPERATIONS OR ANY UNPLANNED SUSPENSION OF ACCESS TO Kenanté THAT MAY OCCUR DUE TO TECHNICAL REASONS OR FOR ANY REASON BEYOND Kenanté CONTROL. THE USER UNDERSTANTS AND AGREE TAHAT ANY MATERIAL OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH Kenanté IS DONE ENTIRELY AT THEIR OWN DISCRETION AND RISK AND THEY WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO THEIR COMPUTER OR MOBILE PHONE SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL OR DATA. Kenanté IS NOT RESPONSIBLE FOR ANY TYPOGRAPHICAL ERROR LEADING TO AN INVALID REDEMPTION COUPON. Kenanté ACCEPTS NO LIABILITY FOR ANY ERRORS OR OMISSIONS, WITH RESPECT TO ANY INFORMATION PROVIDED TO WHETHER ON BEHALF OF ITSELF OR THIRD PARTIES.
11.4 Kenanté SHALL NOT BE LIABLE FOR ANY THIRD PARTY PRODUCT OR SERVICES. THE ADVERTISEMENT AVAILABLE ON E- MAIL OR WEBSITE OR MOBILE PHONE APPLICATION FOR ANDROID ANDIOS OPERATING SYSTEMS WITH RESPECTTO THE THIRD PARTY WEBSITE OR THE PRODUCTS AND SERVICES ARE FOR INFORMATION PURPOSE ONLY.
12 Indemnification and Limitation of Liability
12.3 In no event shall Kenanté, its officers, directors, employees, partners be liable to you, the vendor or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable or whether or not Kenanté has been advised of the possibility, including breach of contract or warranty, negligence or other tortuous action, or any other claim arising out of or in connection with your use of in connection with your use of or access to Kenanté, Services or materials.
12.4 The limitation and exclusions in this section apply to the maximum extent permitted by applicable law.
13.2 You agree that Kenanté may, in its sole discretion, and without prior notice, terminate your access to Kenanté, for cause, which includes (but is not limited to) : (1) request by law enforcement or other government agencies; (2) a request by you (self initiated account deletion); (3) discontinuance or material modification of Kenanté or any services offered on or through Kenanté ; or (4) Unexpected technical issues or problems.
Kenanté is required to do so by law (for example, where the provision of the service to you is, or becomes, unlaw); or
Kenanté has elected to discontinue , with or without reason, access to Kenanté, the services (or any part thereof); or
The provision of the services to you by Kenanté is, in Kenanté opinion, no longer commercially viable;
14.3 Kenanté may also terminate or suspend all or a portion of your account or access to the services with or without reason. Expect as may be set forth in any additional terms applicable to a particular service, termination of your account may include: (i) removal of access to all offerings within Kenanté or with respect to the services: (ii) deletion of your materials and account information, including your personal information, log in ID and password, and all in ID and password, and all related information, files and materials associated with or inside your account (or any part therefore); and (iii) baring of further use of the services.
14.4 You agree that all terminations shall be made in Kenanté sole discretions and that Kenanté shall not be liable to you or any third party for any termination of your account(and accompanying deletion of your account information), or your access to Kenanté and services.
14.6 If you or Kenanté terminates your use of Kenanté , Kenanté may delete any content or other materials relating to your use of Kenanté and Kenanté will have no liability to you or any third party for doing so.

18.1 You hereby expressly agree to receive communications by way of SMS, e-mails, newsletters and any other appropriate communication media from Kenanté relating to Services provided through Kenanté.
18.2 User can unsubscribe/ opt-out from receiving communications from Kenanté by sending feedback to us via Kenanté mobile application or website or by contacting us via email requesting the same.

Any feedback you provide to this website or mobile Application for any android or iOS operating systems shall be free to use such information on an unrestricted basis. Further, by submitting the feedback, you represent and warrant that (i) your feedback does not contain confidential or proprietary information of you or of third parties (ii) Kenanté is not under any obligation of confidentiality, express or implied, with respect to the feedback (iii) Kenanté may have something similar to the feedback already under consideration or in development; and (iv) You are not entitled to any compensation or reimbursement of any kind from Kenanté for the feedback under any circumstances.

How Information Is Used:
The Information We Collect and How We Use It
When you register as a panel member, we collect the following personal identifying information: your name, postal service address, email address, and phone number.
We use your name and email address to let you know about opportunities to take surveys/contests, to provide new updates about Kenanté that may be of interest to our panellists and to inform you about special programs and benefits we are offering to our panel members (such as special gifts or incentives). Generally, panel members are notified about an opportunity to take a survey/contest several times per month. We also send brief emails to our interactive panel members several times a year to provide information of interest and to express our appreciation for their participation.
We use postal service addresses to mail free gifts offered to panel members, products to test, and/or merchandise that you redeem with your Reward Points. Products to test and cash redemptions may be mailed directly to panel members by the Kenanté team and thus do not require sharing of your name and address with outside parties. However, your name, postal service address and email address may also be shared with Kenanté reward suppliers when you redeem your Rewards. Points so they can ship to you directly. Occasionally, we ask our interactive panel members if they would be willing to take certain special paper and pencil surveys/contests. We ask your permission prior to mailing such surveys/contests or sending our representative to your address with prior appointment, as well as providing information about the benefits of taking such a survey/contest .
We call panel members in response to their request for a return call to answer a question or address any concerns. We also call panel members for answering some surveys/contests which need quick responses or need detailed interaction which cannot be done through our app or website only. On rare occasions, we call panelists to validate survey/contest responses.
Kenanté frequently asks panel members for demographic information (e.g., age, gender, household composition, etc.), computer and web access capabilities, and lifestyle information (e.g., types of vehicles owned or business/recreational travel, etc.). Kenanté uses this information to select surveys/contests that are appropriate for the panel member (or a member of the panelists household). For example, a survey/contest related to satisfaction with stays at various hotel chains might be sent only to those panelists who indicate a certain frequency of travel. We sometimes use birth date information to send birthday greetings to our panel members.
Kenanté asks panel members for their opinions about a variety of products and services by asking them to complete surveys/contests via the Kenanté app or website or over a call. Usually, Kenantécombines the individual panelist responses and reports on the aggregated (or group) results. Individual level responses are occasionally used, but in general not associated with any personal identifying information without your explicit consent.
Kenanté may occasionally ask for personal identifying information as part of a specific survey/contest . In these cases, we will provide an explanation in the survey/contest introduction to allow panel members to make an informed decision about participation. The explanation will include a description of any new personal identifying information that will be collected via the survey/contest and with whom it will be shared. As with any survey/contest , members can decline to take the survey/contest or stop at any time during the survey/contest process. Like all other information we collect, any personal identifying information collected for a specific survey/contest will be used for research purposes only.
Kenanté also automatically collects information via log files to administer the app and the site and to aid in technical problem solving. Log file information collected is IP address, time a page was viewed, name of pages viewed within the Kenanté site during the specific visit, browser type, URL parameters, and cookies that were set by the Kenanté website at the time of the visit. Log files may also include information indicating where a visitor came from. This information is used only to administer the site and to identify and resolve any technical problems related to the site's operation.
When you participate in the Refer-a-Friend Program we ask for your friend's first name and email address. The first name is used in the greeting to personalize the message and the email address is needed to deliver it to your friend. Both pieces of information are only stored long enough to make sure the email was sent without difficulty and never used for any other purpose. Participation in the referral program, like all aspects of Kenanté membership, is completely voluntary.
This app and the website has security measures in place to protect the loss, misuse, and alteration of the information under our control. Panel member names, postal service addresses, and phone numbers are maintained on a secured database accessible only by Varenia CIMS staff. Panel members may also access their own information for the purposes of verifying and updating, but they cannot view other members' information. As with any Internet endeavor, absolute security of information transmitted through channels (communication networks, hardware, software) not directly operated or controlled by us cannot be guaranteed.

Your Decision Not To Participate
Panel members may decline to respond to a survey/contest or opt to drop interactive panel membership at any time. Panelists who prefer not to complete a given survey/contest need not do so.
Panelists who would like to withdraw their membership from the panel may do so at any time on the Kenanté app or Site. Panelists may withdraw membership by clicking on the unsubscribe link found at the bottom of the My Profile page in the member area of the Kenanté site or uninstalling the Kenanté mobile app. We will process all unsubscribe requests within 10 business days of receipt and usually within 48 hours of receipt.
Upon receipt of the drop request, Kenanté may ask you to complete brief survey/contest about the reason(s) for discontinuing membership. This survey/contest is optional and does not involve any additional email; any results will help us improve panel members' experience. Thereafter, Kenanté will stop sending survey/contest notifications.
